Northender since moving here. Last night I was denied access with my service animal. Not only that I was treated with an enormous amount of disrespect by the new owner (son of the prior owner). As a patron and ONE neighbor, I expected far better. My husband, my friends who were present, and I were appalled not only by the violation of law but the way we were spoken to. We will never return again. I would caution any individual with a disability of any nature against patronizing the Northender in the future.
As it seems likely, given the attitude of the new owner throughout our exchange, he may respond and try to misconstrue the incident, I’ll offer some context. When I opened the door, I was immediately told upon entering that I could not have a dog in the establishment. I let the person behind the counter know that I was surprised, given how often myself and others have brought dogs and how often I’ve seen dogs there, and that my dog was a service dog so could not be excluded by law. His response was something along the lines of “well I’m the owner and it’s a liability.” I emphasized that it is not legal to deny a service animal. I have a disability and she is trained to render assistance through specific tasks, and is engaged in training for additional tasks. Apparently the fact that some of her tasks are still in training to him meant that it was acceptable to prevent our entry. That is in no way in accordance with the Americans with Disabilities Act. It’s also a violation of Vermont State Law 9 V.S.A. § 4502 wherein:
“b) An owner or operator of a place of public accommodation or his or her employee or agent shall not prohibit from entering a place of public accommodation:
(1) an individual with a disability accompanied by a service animal; or
(2) an individual who is training an animal to perform as a service animal for an individual with a disability”
I’m an attorney and, when he insincerely let me know he would appreciate “clarity”, I pulled up and reviewed the ADA. I let him know that and how he was in violation of it. Specifically, he can only rightfully bar a service animal or training service animal from his establishment if the animal is not housebroken and uses the bathroom or acts inappropriately while in the establishment. None of that was applicable to this situation.
When I told him this, letting him know he was violating the law, he refused to make eye contact with or respond to me. A woman sitting towards the front of the bar who had also commented on my dog as she had confusion due to denials of her own service dog in training began to offer an apology. He told her to stop. Not only is he setting himself up for an ADA lawsuit, he is just unbelievably rude to his patrons and neighbors.
This is far from the first time I’ve been discriminated against on account of my disability. It is demoralizing and humiliating every time. I guess I’d never had to deal with the new owner before. Even after his father retired, I’d always had lovely bartenders at the Northender. I hope, for their sake, that he treats his employees better than his patrons. I also sincerely hope he learns from this experience and better familiarizes himself with the ADA and related Vermont law, and does not treat anyone else this way moving forwards. It is the job of a business owner to be familiar with laws governing business operations where they reside, not the job of impacted individuals to educate business owners.
